COMMISSION OF INQUIRY: Proposed Remediation of the former Allied Feeds site, Canada Bay local government area
The Honourable Dr Andrew Refshauge, MP, Deputy Premier, Minister for Planning, Minister for Aboriginal Affairs and Minister for Housing, has pursuant to Section 119 of the EP&A Act, appointed Commissioner Kevin Cleland, Deputy Chairperson of the Commissioners of Inquiry for Environment and Planning, to conduct a Commission of Inquiry into "all environmental aspects" of the proposed remediation of the former Allied Feeds site, 42 Walker Street, Canada Bay local government area.
The Commissioners of Inquiry are independent of State Government departments and Council.
After considering the findings and recommendations of the Commission of Inquiry, the Minister will determine the matter. Each party appearing before the Inquiry will be advised of the Commissioner's findings and recommendations.
INQUIRY SESSIONS AND VENUE
The Inquiry will be held at the Hearing Room, Office of the Commissioners of Inquiry, Level 13, 301 George Street, Sydney. It will be conducted in two sessions. The first session (primary submissions) will commence at 9:30am, Tuesday, 11 March 2003 and continue as required. The date for the second session (submissions in reply) will be determined at the close of the first session. The Inquiry will be open to the public.
PREPARING AND LODGING SUBMISSIONS
If you wish to make a submission to the Commission of Inquiry you are required to register by sending FOUR COPIES of your submission together with any supporting documents to the Office of the Commissioners of Inquiry (GPO Box 3415 Sydney 1043) by 1:00pm, Friday, 21 February 2003.
Your submission must be in typed or handwritten form. It may take any form you deem appropriate but must contain a cover sheet detailing the name, address, telephone number (during working hours), facsimile (if appropriate) of the person or group making the submission. You must indicate if you wish to appear before the Commission of Inquiry and the estimated time to present your submission.
Submissions to the Inquiry are public documents and will be placed on public exhibition.
All submissions received by Planning NSW in relation to the Environmental Impact Statement will be considered by the Commission. If you wish your submission to Planning NSW to be considered a submission to the Inquiry, you are required to register as set out above.
INSPECTING BACKGROUND DOCUMENTS AND SUBMISSIONS TO THE INQUIRY
You may inspect the Development Application, Environmental Impact Statement and associated documents at the following locations during office hours from 10:00am, Monday, 16 December 2002. Submissions to the Inquiry may be inspected from 10:00am, Friday, 28 February 2003.

Lodging Questions
Questions arising from issues raised in primary submissions must be directed to the relevant party in writing, with a copy lodged with Mrs Paula Poon of this Office not later than 4:00pm, Monday, 17 March 2003.
Responses
Responses to questions are required to be submitted in writing direct to the relevant party, with a copy lodged with Mrs Poon on a date to be determined at the Inquiry.
CONDUCT OF THE INQUIRY
The Inquiry will be held in public unless by reason of the confidential nature of any information the Commission directs otherwise. It will be informal. Neither the rules of evidence nor formal court procedures will apply. Submissions will not be made under oath. You are not required to be legally represented and may read or speak to your submission.
The Inquiry will be conducted in two sessions:
First Session: The purpose of this session is to address preliminary matters and to enable each party to make a primary submission. All material relevant to the Commission's considerations should be presented at this session.
The Commission will consider applications by parties to seek clarification and address questions to any person appearing at the Inquiry. Applications should be made at the conclusion of a person's evidence. The Commission may permit oral questions and answers or may require both to be presented in writing within a specified time period.
Second Session: The purpose of this session is to enable parties, if desired, to sum up their submissions and/or respond to primary submissions and answers to questions given by other parties.
Unless otherwise directed by the Commission, your submission to this session is to be tendered immediately prior to presenting it to the Inquiry, or before the commencement of the session if you are not presenting your submission to the Inquiry
The dates and times for these sessions are set out in the attached Schedule of Dates.
Copies of Submissions and Supporting Documents
Each party is to make available to other parties copies of its submissions and documents tendered to the Inquiry if requested by the Commission.
Order of Appearance
The order of appearance at the first session will be the proponent, followed by other parties as determined by the Commission. The order of appearances at the second session will generally be the reverse of the first session.
Parties who have indicated that they wish to appear before the Inquiry will be notified as to date and time of appearance. If you have not received such notification two days prior to the commencement of hearing, please contact Mrs Poon of this Office on (02) 9299 2904.
Presenting Submissions
Party registered to appear are to present their submission by speaking to them or reading them to the Inquiry, unless otherwise excused or directed by the Commission. Consultants to each party should themselves take the Commission through their submission or reports.
Commissioner's Questions and Requests
Parties should be aware that the Commissioner may ask questions, seek additional information and/or direct that matters be addressed in supplementary submissions.
Site Inspection
The Commissioner will make an inspection of the proposed site and surrounding areas in the presence of interested parties to the Inquiry. Advice concerning the inspection will be given during the Inquiry.
Alteration of Procedures
The Commission of Inquiry reserves the right, where circumstances dictate, to alter procedures or dates related to the Inquiry.
